This Service Agreement (“Agreement”) is a legally binding contract between you (“Client”) and Oleksandr Tuholukov , a reg.#2025049030 Legal Document Assistant (LDA) County of Registration: Los Angeles under California Business and Professions Code §6400 et seq., for the provision of document preparation services. This Agreement is entered into by acceptance of the offer through payment for the service on this website pursuant to California Civil Code §1584.,

PARTIES

  • Provider: Oleksandr Tuholukov, a California-registered business, with an LDA registration number issued by the county of [insert], acting in accordance with Business and Professions Code §§ 6400-6415.
  • Client: An individual or business entity purchasing the service via the Provider’s website by accepting this Agreement through payment confirmation.

SERVICE DESCRIPTION

The Provider offers a fixed-price service package titled “Power of Attorney – Full Service”, which includes:

  • Drafting a Power of Attorney based on information provided by the Client
  • Arranging for notarization of the Client’s signature by a commissioned Notary Public
  • Obtaining an Apostille from the California Secretary of State (pursuant to the Hague Convention of 1961)
  • Mailing of the completed document within the United States or internationally
  • One-time free re-issuance of the Power of Attorney in case of rejection by the receiving authority

Service Fee: $270 (USD) — inclusive of all associated costs: notary, apostille, shipping
Optional expedited service may be available upon request, subject to additional fees and Provider’s availability.

ACCEPTANCE & FORMATION OF CONTRACT

By clicking the payment button and submitting the order form, the Client affirms:

  • Full legal capacity to enter into a binding agreement
  • Acceptance of all terms set forth herein (California Civil Code §1550, §1584)
  • Consent to receive services and communications electronically (15 U.S.C. §§7001 et seq. – E-SIGN Act)

This Agreement becomes effective upon the Provider’s receipt of full payment.

LEGAL DISCLOSURE (LDA STATUS)

The Provider is not an attorney and does not provide legal advice or representation.
Services are rendered solely within the statutory authorization under:

  • California Business and Professions Code §6400 – §6415
  • Client is solely responsible for determining whether the documents provided meet the legal requirements in the receiving jurisdiction.
  • No attorney-client relationship is created.

⚠️ As required by BPC §6410.5, the Provider shall disclose their LDA registration details upon request and provide a statutory notice prior to commencement of services.

PAYMENT AND REFUND POLICY

  • Payment is due in full at the time of order via the website’s secure checkout system.
  • Refunds are available only if the Provider is unable to fulfill the order due to internal error or refusal by the Client to proceed prior to commencement of work.
  • Once document preparation has begun, the service is considered rendered under California Civil Code §1689(b)(4) (exceptions to cancellation rights).

TIMELINE & DELIVERY

  • Standard turnaround:
    – 1 business day for document preparation
    – 1 business day for apostille processing
  • Delivery via USPS, FedEx, or equivalent with tracking
  • Expedited same-day service available only upon written confirmation, subject to provider schedule and county submission deadlines

CLIENT OBLIGATIONS

Client agrees to:

  • Provide accurate, complete, and truthful information
  • Review and approve drafts in a timely manner
  • Respond to requests for additional information promptly
    Failure to cooperate may result in delay or cancellation of the service without refund.

CONFIDENTIALITY & DATA PROTECTION

All personal data is processed in accordance with:

  • The California Consumer Privacy Act (CCPA) – Cal. Civ. Code §§1798.100 et seq.
  • The Federal Trade Commission Act (FTC Act) for consumer protection
  • Data is used solely for the fulfillment of this service and is not shared without written consent, unless required by law.

LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • The Provider shall not be liable for any indirect, incidental, or consequential damages
  • Total liability shall not exceed the amount paid by the Client
  • The Provider does not guarantee acceptance of the Power of Attorney by any specific authority outside the U.S.

GOVERNING LAW

This Agreement shall be governed by and construed under the laws of the State of California, without regard to its conflict of law provisions.
Venue for any legal proceedings shall be the courts of Los Angeles County, California.

ENTIRE AGREEMENT & SEVERABILITY

This document constitutes the entire agreement between the parties.
If any provision is found invalid or unenforceable, the remainder shall remain in full force and effect.

Consent

By submitting payment and placing the order, the Client confirms understanding and acceptance of the terms of this Service Agreement.
